The ruling he wrote was actually strange in my opinion. We have the right to drive through fast food restaurants and eat microwaved burgers at gas stations, but you can not have a glass of milk from your own cow. How udderly ridiculous. With this kind of power it makes one wonder why he would leave that judicial seat. Hmmmm???

Well I received the following information this afternoon from G.L., I will not theorize here but rather let you draw your own conclusions.

Earlier this month, Wisconsin Judge Patrick J. Fiedler issued a response to the Farm-to-Consumer Legal Defense Fund regarding the Constitutionality of food rights. In his response, Judge Fiedler stated “Plaintiffs do not have a fundamental right to consume the milk from their own cow.” He then went further stating, “Plaintiffs do not have a fundamental right to produce and consume the foods of their choice.”

So, what does this mean? You have NO right (according to Judge Fiedler) to raise animals, crops or even an orchard or backyard garden. You have NO right to choose what food you eat. The government has the right to mandate or prohibit the consumption of any food.

What would motivate Judge Fiedler to issue such a shocking ruling against food rights? Well, a quick Internet search reveals some clues. Within days of his ruling against food rights, Judge Fiedler announced he has decided to retire and will resign his position as judge September 30. He will go into private practice, as an attorney for the Axel Brynelson Law Firm.

I did some research on the Axel Brynelson Law Firm and found that in May 2010, the firm represented Monsanto in a lawsuit concerning a DNA patent. So, within days of ruling that Americans have no right to produce and consume the foods of their choice, Judge Fiedler is hired by a law firm that represents Monsanto. What a coincidence!

Strange bedfellows indeed!

Beware the Agricultural Industrial Complex

http://www.jeffersonwapf.org/1/post/2011/09/beware-the-agricultural-industrial-complex.html

http://www.jeffersonwapf.org/1/post/2011/09/beware-the-agricultural-industrial-complex.html#comments

Uncategorized

I had posted this to a national food freedom blog earlier this year. Now we have reached the pinnacle. The coming "War on Food" will only create more felons, prisoners, and law enforcement jobs. We can expect an increase in food raids against the private buyers clubs, farmers markets, and eventually your garden. You will be criminalized for growing your own nutritionally dense organic foods, even possession of a slice of raw cheese may be enough to get you time in their ever growing prison system.
The raid of Rawsome Foods this past year (2010) was a test for the new "War on Food". Jackbooted thugs coming into a private food distribution center with guns drawn! Yes, that is what we can expect to see over the coming years as the FDA and the USDA become militarized. There are already plans on the table for the federal agencies to recruit help on the state level from agencies, such as DATCP here in Wisconsin, to enforce this draconian "Food Safety" legislation. When we wake up in 2011 farmers will be relegated to the level of drug dealers and those who choose to consume those homegrown foods as junkies. Your neighbor may even get a reward if they call the FDA hot line and report that you have too many tomato plants in your garden. Are you prepared for when the FDA comes crashing through your garden fence in the name of "Food Safety"?
There is a war on for your food. Will you stand up to this tyranny, or live in fear and be a good slave?
The tyranny we are about to face in this country will make the oppressive days of the Soviet Union look all too mild.
Copyright 2011
A

REPUBLIC vs. DEMOCRACY

http://www.jeffersonwapf.org/1/post/2011/09/republic-vs-democracy.html

http://www.jeffersonwapf.org/1/post/2011/09/republic-vs-democracy.html#comments

Uncategorized

"I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all."In the Pledge of Allegiance we all pledge allegiance to our Republic, not to a democracy. "Republic" is the proper description of our government, not "democracy." A republic and a democracy are identical in every aspect except one. In a republic the sovereignty is in each individual person. In a democracy the sovereignty is in the group.

Republic. That form of government in which the powers of sovereignty are vested in the people and are exercised by the people, either directly, or through representatives chosen by the people, to whome those powers are specially delegated. [NOTE: The word "people" may be either plural or singular. In a republic the group only has advisory powers; the sovereign individual is free to reject the majority group-think. USA/exception: if 100% of a jury convicts, then the individual loses sovereignty and is subject to group-think as in a democracy.]

Democracy. That form of government in which the sovereign power resides in and is exercised by the whole body of free citizens directly or indirectly through a system of representation, as distinguished from a monarchy, aristocracy, or oligarchy. [NOTE: In a pure democracy, 51% beats 49%. In other words, the minority has no rights. The minority only has those privileges granted by the dictatorship of the majority.]

The distinction between our Republic and a democracy is not an idle one. It has great legal significance. The Constitution guarantees to every state a Republican form of government (Art. 4, Sec. 4). No state may join the United States unless it is a Republic. Our Republic is one dedicated to "liberty and justice for all." Minority individual rights are the priority. The people have natural rights instead of civil rights. The people are protected by the Bill of Rights from the majority. One vote in a jury can stop all of the majority from depriving any one of the people of his rights; this would not be so if the United States were a democracy.

In a pure democracy 51 beats 49[%]. In a democracy there is no such thing as a significant minority: there are no minority rights except civil rights (privileges) granted by a condescending majority. Only five of the U.S. Constitution's first ten amendments apply to Citizens of the United States. Simply stated, a democracy is a dictatorship of the majority. Socrates was executed by a democracy: though he harmed no one, the majority found him intolerable.

Notice that in a Democracy, the sovereignty is in the whole body of the free citizens. The sovereignty is not divided to smaller units such as individual citizens. To solve a problem, only the whole body politic is authorized to act. Also, being citizens, individuals have duties and obligations to the government. The government's only obligations to the citizens are those legislatively pre-defined for it by the whole body politic.

In a Republic, the sovereignty resides in the people themselves, whether one or many. In a Republic, one may act on his own or through his representatives as he chooses to solve a problem. Further, the people have no obligation to the government; instead, the government being hired by the people, is obliged to its owner, the people.

The people own the government agencies. The government agencies own the citizens. In the United States we have a three-tiered cast system consisting of people ---> government agencies ---> and citizens.

The people did "ordain and establish this Constitution," not for themselves, but "for the United States of America." In delegating powers to the government agencies the people gave up none of their own. (See Preamble of U.S. Constitution). This adoption of this concept is why the U.S. has been called the "Great Experiment in self government." The People govern themselves, while their agents (government agencies) perform tasks listed in the Preamble for the benefit of the People. The experiment is to answer the question, "Can self-governing people coexist and prevail over government agencies that have no authority over the People?"

The citizens of the United States are totally subject to the laws of the United States (See 14th Amendment of U.S. Constitution). NOTE: U.S. citizenship did not exist until July 28, 1868.

Actually, the United States is a mixture of the two systems of government (Republican under Common Law, and democratic under statutory law). The People enjoy their God-given natural rights in the Republic. In a democracy, the Citizens enjoy only government granted privileges (also known as civil rights).

There was a great political division between two major philosophers, Hobbes and Locke. Hobbes was on the side of government. He believed that sovereignty was vested in the state. Locke was on the side of the People. He believed that the fountain of sovereignty was the People of the state. Statists prefer Hobbes. Populists choose Locke. In California, the Government Code sides with Locke. Sections 11120 and 54950 both say, "The people of this State do not yield their sovereignty to the agencies which serve them." The preambles of the U.S. and California Constitutions also affirm the choice of Locke by the People.

It is my hope that the U.S. will always remain a Republic, because I value individual freedom.

Thomas Jefferson said that liberty and ignorance cannot coexist.* Will you help to preserve minority rights by fulfilling the promise in the Pledge of Allegiance to support the Republic? Will you help by raising public awareness of the difference between the Republic and a democracy?

   * "If a nation expects to be ignorant and free, in a state of civilization,
it expects what never was and never will be."
Thomas Jefferson, 1816.

The Coming Secret Raw Milk Tax

http://www.jeffersonwapf.org/1/post/2011/09/the-coming-secret-raw-milk-tax.html

http://www.jeffersonwapf.org/1/post/2011/09/the-coming-secret-raw-milk-tax.html#comments

Uncategorized

The Coming Secret Raw Milk Tax There is a scheme brewing in the Raw Milk Industry to increase revenue for the self appointed elite of the raw milk movement. One question for the pediatrician's, where are all the bodies? When I inquired about how many children have been admitted or treated for raw milk related illnesses at Children's Hospital in Milwaukee last week Friday the response was NONE! And when I asked why they were opposing the raw milk bill they started to scramble and really had no response after being trapped in repeating the lies of the Agricultural Industrial Complex.
If drinking raw milk is so dangerous, where are all the sick and dying people in Wisconsin from drinking all this raw milk ?
They do not exist. They only exist in the imagination of the fear mongering lobbyist and dairy industry corporations. They fear that people, voters, will choose the food they want for their families and many families will not choose pasteurized milk for their families. I know many people who choose not to drink pasteurized milk. Why are we denied this liberty by the influence of the lobbyists and dairy corporations?
In denying the citizen’s the right of food choice, the lobbyists, and their employers, become the sole beneficiaries of any milk sales in the state of Wisconsin. The Agricultural Industrial Complex has had a stranglehold monopoly on the Wisconsin dairy industry.
Family farms had almost been eradicated from the landscape across the dairy state creating a monopoly for the Agricultural Industrial Complex. All was well until a few brave farmers decided to share nutrient dense, grass fed, organic, farm fresh, unprocessed milk with the families of many people across the state who were looking for real food for the health of their families.
After the Wisconsin legislature passed the Raw Milk bill in 2010 (25-8 in the Senate, 60-30 in the Assembly) Shawn Pfaff was so motivated to prevent people from having the choice to chose the food they want to consume that he organize the delivery of 36 letters asking Governor Doyle to veto the Raw Milk bill. Shawn got 5 medical associations and 31 dairy industry associations to send letters to ask Governor Doyle to veto the Raw Milk Bill. Interestingly 21 of the 31 letters from the dairy industry associations urging the governor to veto the Raw Milk bill were exactly the same letter. How can 21 different organizations produce the exact same letter? The majority of these letters were dated either May 7th and 13th with a few dated April 26th.
We all know how this works. Somehow, some of Shawn’s contacts faxed a form letter written by someone else.
This year Shawn Pfaff has organized the Wisconsin Safe Milk Coalition, (slick name don’t you think) to opposed the Raw Milk Bill well before the legislators have an opportunity to ask their constituents their opinion of people having the right to chose the food they want for their families. I have heard this type of action being called short circuiting the process of democracy.
None of the families selling raw milk in Wisconsin want anyone to get sick from drinking raw milk. Some of these farms have been selling raw milk for over 15 years and no one has ever reported getting sick from consuming their raw milk. This demonstrates that raw milk can be safely produced by the farmers and consumed. Today there are 27 other states that have some form of legalize sale of raw milk across the country.
Now let us look at reality for a minute. 170,000 raw milk drinkers each consume 1 glass of milk each day in Wisconsin. That would be 62,050,000 glasses of raw milk consumed in Wisconsin annually. Over the course of the last 15 years that would be 930,750,000 glasses of raw milk consumed in the dairy state. Almost one billion glasses served and that is assuming everyone only drinks one glass a day. Where are all the bodies?

Saftey? A group of state farm groups, health professionals and commerce leaders are banning together to urge lawmakers to reject any efforts to legalize the sales of raw milk. Calling themselves the Wisconsin Safe Milk Coalition, the 15 organizations wrote to members of the state Legislature on Thursday asking them not to co-sponsor a bill that would permit the on-farm sale of unpasteurized milk--which they say is supported by 'a small number of Wisconsin residents who believe the benefits of drinking raw milk outweigh the risks.'

Members of the newly-formed coalition include Associated Milk Producers Inc., Children's Hospital and Health System of Wisconsin, Cooperative Network, Foremost Farms USA, Land O' Lakes, Marshfield Clinic, Wisconsin Association of Local Health Departments and Boards, Wisconsin Chapter of the American Academy of Pediatrics, Wisconsin Cheese Makers Association, Wisconsin Dairy Business Association, Wisconsin Dairy Products Association, Wisconsin Manufacturers and Commerce, Wisconsin Medical Society, Wisconsin Public Health Association, and Wisconsin Veterinary Medical Association.
BOYCOTT the above companies and call them and tell them shame on you for being corporate fascists.

These food fascists are not about safe milk, if they were they would be getting after the confinement operations that are cruel and filthy, and there are very many around the dairy state. I will refer to this group of 15 as the Wisconsin Agricultural Industrial Complex.

The Wisconsin Agricultural Industrial Complex (WAIC) is in oppositoin to growth, new industry, competition, jobs and additional revenue for our financially troubled state. The WIAC has had a death grip on farmers for many years and now that people are buying local and small family farms are making a little bit of a comeback in the daiy state, they want to squash our rights and control our representatives in state government. Who put the Senators, Legislators, and Governor in office at the voting booth? Us or the WIAC?
Call your representatives and tell them that they will not be reelected to another term in office if they put corporate interst over the rights of we the people.

Bricks and Mortar

http://www.jeffersonwapf.org/1/post/2011/03/bricks-and-mortar.html

http://www.jeffersonwapf.org/1/post/2011/03/bricks-and-mortar.html#comments

Uncategorized

Sincere, hard working farmers are producing quality nutrient dense foods and doing it safely already. The alleged outbreaks have not done any harm to the dairy industry of Wisconsin. I believe Scott is trying to eliminate any objections to raw milk by the government by doing more than the minimum required. He is shooting for the stars and very passionate in his ways. Having a certain amount of responsibility to the raw milk industry is key by all involved, both consumer and producer. When you live near the wolf's den (DATCP) you become easier prey and need to build with brick rather than straw or sticks. When government regulators began to act like dictators and legislators, we needed to assert our rights and not allow them to be trampled upon. I know Scott, he is not trying to divide the raw milk movement, but rather working his niche that he feels comfortable with, safety. Think of it this way, safety is the bricks and our rights are the mortar, one cannot stand without having the two act as one integral unit, otherwise we will have failure if we stand alone.
